Akavar 20/50 Class Action Lawsuit
A suit seeking class action status was filed against Basic Research, Dynakor Pharmacal, Western Holdings and Dennis Gay, Daniel B. Mowrey, Ph.D.; and Mitchell Friedlander. The filed complaint claims that the defendants ‘engaged in a deliberate campaign of widespread fraud and deception’ by marketing Akavar 20/50 with false claims that taking it could result in weight loss without modification of diet or increasing exercise. It was also incorrectly asserted that it was ‘designed by a team of doctors working in a recognized university’ and to have even been supported by published academic research. In May 2008, the plaintiffs filed anĀ amended complaint regarding Akavar including claims of racketeering and violations of the RICO statute. The complaint states that the defendants have engaged in similar deceptive behavior in the past and even had to settle with the FTC regarding previous false claims.
Akavar was marketed as a ‘New! European weight loss breakthrough’ and further claimed that ‘Studies have proved a virtual 100% success rate among the participants.’ The complaint states that the defendants knew that none of these claims were true.
